Topic: An Update on the Twin Pillars of Trade: Compliance
and Security.
Trade professionals with Gardner Carton & Douglas LLP, Kathi
Murphy and Karen Lobdell, will provide an overview of timely
trade compliance and security matters.
I. Trade Compliance
In 2005, trade compliance took on an enforcement bent. More
so than in the past, compliance lapses, especially involving
known risk areas invoked a harsh response from U.S. Customs
and Border Protection. The best example of CBP enforcement
activity can be found in the U.S. v. Ford cases, wherein the
U.S. Court of International Trade upheld the agency’s
penalty assessments. This aspect of the presentation will
focus on lessons to be learned from the Ford cases in
building and maintaining a trade compliance program.
II. Trade Security
In the past four years, security has taken a front seat with
regard to the priorities of U.S. Customs and Border
Protection. However, the U.S. is not alone in continuing to
develop and implement initiatives that will secure their
borders. Supply chain security has gone global. This aspect
of the presentation will provide an update as to the status
of various U.S.-based security initiatives (e.g. C-TPAT,
CSI, Trade Act of 2002) and will also provide an overview of
some of the global initiatives that businesses will
encounter in the coming years (e.g. WCO Framework of
Standards).
